In the past few years judicial courts have been exercising an important role on the main political discussions in constitutional democracies. The electoral process is one of these debates where courts are protagonist actors, which leads to a potential tension between popular sovereignty and constitutionalism. Our paper shows this phenomenon in Brazil by analyzing the normative scope of electoral consultation in the Tribunal Superior Eleitoral.
